Terms of Service

By accessing or using StreamBuddy ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. StreamBuddy is a multi-platform live stream assistant that provides text-to-speech, overlays, and stream management tools for content creators.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service — including the StreamBuddy desktop application — for your own streaming purposes.

StreamBuddy is currently in Closed Beta. Access is restricted to whitelisted accounts only. We reserve the right to:

• Grant or revoke beta access at our sole discretion
• Modify, suspend, or discontinue any aspect of the Service without notice
• Reset or delete user data during the beta period without liability
• Change these Terms at any time, with changes effective upon posting

THE SERVICE IS PROVIDED "AS IS" DURING BETA. WE MAKE NO GUARANTEES OF UPTIME, DATA PERSISTENCE, OR CONTINUED AVAILABILITY.

To use StreamBuddy, you must authenticate using a supported provider (TikTok, Twitch, or Discord) via OAuth. You agree to:

• Provide accurate information and maintain accurate account details
• Maintain the security of your platform authentication credentials
• Notify us immediately of any unauthorized access to your account
• Use only accounts you own or have explicit permission to connect

You are responsible for all activities that occur under your account. We reserve the right to terminate accounts that violate these Terms or engage in abusive behavior.

StreamBuddy integrates with TikTok, Twitch, and other third-party platforms ("Platform Providers"). You acknowledge that:

• Platform integrations are subject to the terms and policies of those platforms
• We are not responsible for changes to Platform Provider APIs that affect functionality
• Platform Providers may revoke API access at any time, which may impact the Service
• You must comply with all applicable Platform Provider terms of service
• StreamBuddy accesses only the permissions you explicitly grant via OAuth

StreamBuddy is not affiliated with, endorsed by, or sponsored by TikTok, Twitch, Discord, Spotify, or any other third-party platform. Those names and marks belong to their respective owners.

You agree NOT to use StreamBuddy to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, transmit, or display content that infringes the copyright, trademark, or other intellectual property rights of others — including unlicensed audio in sound alerts
• Harass, abuse, threaten, or incite violence against any individual or group
• Distribute spam, malware, or other malicious content through TTS or overlays
• Attempt to circumvent safety filters or moderation systems
• Reverse engineer, decompile, or extract source code from the Service
• Use automated systems to scrape, abuse, or overload our infrastructure
• Impersonate others or misrepresent your affiliation with any person or entity
• Share or distribute your account access with unauthorized parties

Violation of this policy may result in immediate account suspension or termination.

StreamBuddy's TTS and safety filtering features are designed to help you moderate content, but:

• You are solely responsible for all content displayed on your stream
• Safety filters may not catch all inappropriate content—you must actively moderate
• We are not liable for any offensive, harmful, or illegal content processed by the Service
• You grant us a limited license to process stream events and messages for TTS functionality

StreamBuddy and its original content, features, and functionality are owned by StreamBuddy and are protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service without permission
• Use our trademarks or branding without written consent
• Remove or alter any copyright, trademark, or proprietary notices

You retain ownership of your stream content and configuration settings.

StreamBuddy offers a Free plan and an optional paid Pro subscription, billed through our payment provider (Polar). Core features remain free during the Closed Beta phase. For paid subscriptions:

• Pricing and billing terms are shown before you subscribe
• Pro renews automatically each billing period until canceled. You can cancel at any time — access continues through the end of the paid period, and no partial-period refunds are issued
• Payments are processed by our merchant of record, Polar, which is responsible for collecting and remitting applicable taxes
• Beta users may receive promotional pricing or grandfathered benefits
• All fees are non-refundable unless otherwise stated or required by law

StreamBuddy offers an optional referral program and a separate, application-based affiliate program. Participation in either is subject to these Terms plus the following conditions.

Referral program

• When someone signs up through your referral link and completes their first paid subscription, you receive the complimentary Pro time shown on the Referrals page. Referred users may receive a Pro trial or checkout discount as shown during signup.
• Complimentary Pro time has no cash value, is non-transferable, and cannot be redeemed for money.
• Self-referrals, multiple accounts, and any manipulation to farm rewards are prohibited and void the associated rewards.

Affiliate program

• The affiliate program requires an application and is open to users 18 or older. We approve, deny, or suspend applications at our discretion.
• Affiliates are independent contractors — nothing in the program creates an employment, agency, partnership, or joint venture relationship.
• Before receiving a payout you must provide accurate payout details and, where required for tax reporting, a completed IRS Form W-9 (US persons) or W-8 (non-US persons). We may hold payment until required forms are provided, and you are responsible for any taxes owed on your earnings.
• Commissions are cash-denominated as shown on your affiliate dashboard: a flat amount on each referred user's first paid month, plus a percentage of renewals while they stay subscribed. Rates may change prospectively; accrued earnings are not retroactively reduced.
• Earnings become payable after a holding period (shown on your dashboard) covering refunds and chargebacks. Refunded or reversed orders are clawed back as negative earnings.
• Payouts are sent to the PayPal address you provide; payments routed through PayPal are reported by PayPal under its own tax-reporting obligations.
• Unpaid earnings may be exchanged for complimentary Pro days at the rate shown on your dashboard; exchanges are final.
• When promoting StreamBuddy you must clearly disclose that you earn a commission, comply with applicable advertising and disclosure rules (including FTC endorsement guidelines), and must not use spam, misleading claims, self-referrals, or paid advertising on our trademarks.
• You may not participate if you are located in a country or region subject to comprehensive US sanctions, or if you appear on a US sanctions or denied-persons list.

We may modify or discontinue either program at any time. Accrued, legitimate rewards and earnings are honored; rewards or earnings obtained through fraud, abuse, or violations of these Terms are void. Suspending or terminating your account may forfeit pending program benefits.

We respect intellectual property rights and expect users to do the same. If you believe content available through the Service infringes your copyright, send a written notice to our designated agent at dmca@streambuddy.xyz including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a good-faith statement that the use is unauthorized; (e) a statement under penalty of perjury that you are authorized to act for the copyright owner; and (f) your physical or electronic signature.

If you believe material was removed in error, you may send a counter-notice to the same address. We may restore removed material unless the original complainant files a court action, as described in 17 U.S.C. §512.

We terminate the accounts of repeat infringers in appropriate circumstances.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or availability of the Service
• Compatibility with your streaming setup or platforms

IN NO EVENT SHALL STREAMBUDDY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Stream downtime, viewer loss, or platform bans
• Damages resulting from TTS content, overlay malfunctions, or safety filter failures
• Third-party platform changes that affect Service functionality

Our total liability shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

You agree to indemnify and hold harmless StreamBuddy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Violation of these Terms or applicable laws
• Content displayed on your stream via StreamBuddy features
• Infringement of third-party intellectual property rights

Your use of StreamBuddy is governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• At your request
• End of the beta program

Upon termination, your right to use the Service will immediately cease. We may delete your data in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved through final and binding individual arbitration rather than in court, except either party may assert claims in small claims court if they qualify.

YOU AND STREAMBUDDY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.

You may opt out of the arbitration and class-waiver provisions by emailing support@streambuddy.xyz within 30 days of first accepting these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

• No Waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Survival: Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive.
• No Third-Party Beneficiaries: These Terms create no rights in anyone other than you and StreamBuddy.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StreamBuddy regarding the Service and supersede all prior agreements and understandings.
